Legal Question in Family Law in Michigan

Retrieving funds from FOC

OK. I cannot get anywhere with Wayne County FOC. I have a motion to terminate the support order. I filed it on August 21. I have yet to hear anything about it. Also, They have withheld (since Sept. 30, 2001) $1036.50, and have dispbursed $0. Is there any way I can sue them for not responding to my Motion, or dispbursing the money? Also, the children that I am paying support for, I live with them and their mother. Which is why I have the Motion filed. I cannot get ahold of anyone, just their automated system. And when I get ''transferred'' to the correct department, it just ''hangs up''. I am in danger of losing the only vehicle we own, and the home we live in due to the WCFOC non dispbursement.

Re: Retrieving funds from FOC

To Whom It May Concern:

This is in response to your email of November 8, 2001.

Unfortunately your problem is due to inundated Wayne County Court docket. If your motion was properly filed and served, it should be on the court docket and will hopefully be heard soon. To hopefully get an answer to your questions you may want to appear at the Wayne County Friend of the Court downtown Detroit and possibly set up an appointment if need be.

Otherwise, better results could occur if you have an attorney assisting you in this regard. Our rates are $175.00 per hour with an up front retainer of $1,700.00.

Thank you for your question.

Very truly yours,

Nichols & Eberth, P.C.
