Legal Question in Family Law in Michigan

When my son was born his mom was still legally married, and this mans name went on the birth certificate. I have filled out paper work, and am now told it is up to the mother to finish. We split up when he was 18 months, and he is now seven. I have no parental rights. I do see my son every weekend, but have no leg to stand on when it comes to important decisions. What can I do to make her change the name?

You are describing a complicated legal situation that would involve Michigan's new Revocation of Paternity Act. It will be necessary to set aside the previous determination of parentage and then name you as the legal father of the child. Once that occurs, you may be awarded legal rights. Please note that you must properly file your action with the court before June 12, 2013. If you fail to do so you will lose any right to ask the court for relief. I would promptly contact a family law attorney who has experience working with the new act.
