Legal Question in Civil Litigation in Michigan
In April I made a trip from Grand Rapids Michigan to Tupelo MS to look for a place of business. I happened across a building and house and reached a verbal agreement with the owner for 10,000 deposit on the business with payment of 600 mo for the remaining amount of $60,000. Along with the rental of the home until I felt secure in purchase, in which all payment would be applied as a deposit and 600 a month thereafter for $60,000. The owner agreed to replace the kitchen cupboards and counter tops, along with furnishing appliances and replacing windows and shower. He also agreed that he would cover the cost to replace windows that were in poor condition or to pay for a heating a/c unit, prior to our arrival. He gave us a guarentee that if there were any problems with the business building he would cover the roof and any electrical or water leaks, as he said he would show proof it was inspected. I let him know we would be relocating the first of august to open and all should be done. We comunicated almost 3 times a week and he stated everything was ready. I relocated my home to mississippi only to find he hadnt accomplished anything we discussed. I gave him an extension of time to complete the list. He did not complete one item, and left all his belongings in the building to be used for a business. When he failed to comply with his end of the agreement I withheld the money until completion. He stated he changed his mind and would not clean out the business or repair most of the items he felt "could just wait a year or so". I made repair on the home while I was waiting for him to come and do his repairs. I hired painters that came in and repainted with quality paint. There were hours and hours of cleaning done prior to him asking for the keys back. Can I sue him for breach of contract for the expenses I have in relocating, labor cost and supplies, deposits and possible lost income,...etc.?
