Legal Question in Civil Litigation in Michigan

contract not signed by me

a garbage company is threatening me that i cant switch them because a former employee of mine at my 7-11 store signed a so called service agreement with them for five years which is not even the industry standard. Is a contract that is not even signed by me, and I'm the only one who can sign a contract for my store, valid. the fax they sent to me doesnt even have my store stamp on it so therefore i dont even know when this former disgruntled employee even signed this. please let me know

Re: contract not signed by me

Your question is can they sue you. Yes. They can sue you. However, they may not win. Your defense would be that the employee did not have the apparent (outward) authority to enter into the agreement. However, if you allowed the employee to have the appearance of a manager, then you may be "on the hook." Whether you allowed the employee to have the appearaance of authority to enter into the contract is a jury question to be decided by a jury. You most likely nee a lawyer to defend you if you get sued. Bill Stern 248-353-9400
