Should I Dismiss Case?

Last month I was sued for an unpaid medical bill ($1500) that should have been covered by insurance. The hospital never filed a proper claim. Two weeks after they sued me, they sent dismissal papers (dismissed without prejudice). They still haven't been paid, and this is still on my credit report. Should I say ''yes'' to dismissal, or will this eliminate hope of getting this off of my credit report? I feel that I have a strong case that they were negligent in the filing of the claim, but don't know what my best options are. I need to complete a ''Pre-Trial Statement'', but don't know how. Any help would be much appreciated.

Allow them to dismiss the case. It may not come back. If they refule, you can use as your defense their duty to file the claim with the insurer timely and properly. You'll probably win. As far as your credit, write a letter of explanation to the various credit agencies and insist that they keep it with your file. William S. Stern
