Re: engagement ring

As the court of appeals stated in BARRY MEYER, D.O.,v. ROBYN MITNICK (2001)

"....an engagement ring given in contemplation of marriage is an impliedly conditional gift that is a completed gift only upon marriage. If the engagement is called off, for whatever reason, the gift is not capable of becoming a completed gift and must be returned to the donor."

Re: engagement ring

(Your fianc is the man you plan to marry; your fiance is the woman you plan to marry. I'm assuming that you are the man, however, because you want the ring BACK.)

An engagement ring given in exchange for a promise to marry (you offer the ring, with the words "Will you marry me?" or something along that scenario) should be returned if the engagement is off.

If you both agreed to become engaged, and the ring was given to her as a gift, she should keep the ring.

Good luck!
