Eviction of a non-paying partner
I am currently living with the father of my child (we're not married), and for the past four months, he has fallen over $2000 behind in paying 'half' of his bills, which he agreed to do when we acquired the home. Both of our names our on the lease of the mobile home in which we reside, and I'm at the point of ending the relationship. He lies constantly, and will not show any evidence of his paycheck to me in over a year. I pay all the bills out of my checking account, which is near depletion. I'm at my wit's end; what would be the best course of actin to take? Could he be evicted? Could I sue him for barely sharing in cost and living expenses? He refuses to put the home up for sale, and with both of our names on the lease, I can't do it on my own. I feel like I'm supporting our family, as he 'tosses' sparse amounts of money my way. He's doctored bank deposit slips to make it look like he has put what he owes into my account (it's in my name only). All bills have been paid in my name. There has to be some help for me! I'm going to end up losing everything if I continue on with him!

What you essentially have is a partnership in the mobile home. See a lawyer and have him file suit to force a saleusing partnership law. You may find that the home doesn't sell and you both wind up losing money. However, can you see yourself living this way for the rest of your life? William S. Sterrn

If you are leasing the mobile home as you state in your question, you cannot evict him. Only the landlord would be able to do that.
