Legal Question in Civil Litigation in Michigan

Immature degrading neighbor

A neighbor adjacent to a piece of property that I'm trying to sell, placed a bunch of junk cars,on his property,so as to seriously detract the value of my property. When I sent the township ordinance person to see him about moving them,he wouldn't Then he placed a sign towards my property that said ''If you don't like it don't look'' along with another degrading sign and a mess of no tresspassing signs to add to the carnage. The ordinance person says that the cars are a violation, but that it may take more than a year to get him to move them.I had a buyer that backed out the day of the closing because of this . What can I do??

Re: Immature degrading neighbor

Sue the neighbor for nuisance and get an injunction. If he doesn't move the cars, with the appropriate court order, he will be picked up and incarcerated. Also, the sheriff will then be able to move the cars, and charge the neighbor. When he doesn't pay, his house can be taken and sold. While a lawyer may charge a bit for such a case, it is worth it as it will definitely increase the value of your property. It is doubtful that you can get the neighbor to pay your legal expenses, unless he files a frivolous defense. If you wish to discuss it further, contact me at 248-353-9400 Bill Stern
