Legal Question in Civil Litigation in Michigan

motion for summary disposition

Help! I am helping a friend who is being sued by a neighbor in civil court. He has submitted his answer to the suit only to be told by the county clerk that he needed to file a motion for summary disposition also. I cannot find this form or any instructions for filing anywhere on the internet. Can you please direct me as to where I might be able to view this form or get a copy of it. Any help in the right direction would be appreciated. Thanks!

Re: motion for summary disposition

I need to know more about the case to understand why the clerk told him that he needs to make a motion for summary disposition. Such a motion basically tells the judge the reasons why the case should be dismissed. A list of the reasons generally is stated in Michigan Court Rule 2.116(C). Read these over and see what applies. Then write out why the case should be dismissed based upon a reason that you find in one of those rules. Bill Stern 248-353-9400

All I can tell you is that the clerk is wrong. Among the three of you, the question arises "Which one of you is Curly?"
