Legal Question in Civil Litigation in Michigan

Notary Public

My husband is a process server, if I became a notary public would I be able to notarize his proof of service? Or is it considered a conflict of interest since we are married?

Re: Notary Public

The problem is the integrity of the proof, because clearly you would be legally able to do this unless the notary ethics rules state otherwise.

Call a few other process service agencies and ask how they handle it. Rather than a legal question, this is more a business process question.

Re: Notary Public

I do not beleive it would be conflict. You would notorize only that he signed a document, not that he did the service.
