Personal propert possession

If someone put a Televison on their credit card for someone else with the agreement that the person would pay for it with cash personaly to them, and no reciepts were given. Then took the person to court saying that they still owed them money and wanted the televison back. Who would the court give possesion to?

The winner would be the person bringing the suit, if the Court believed that person. If the court could not decide who was telling the truth, then the person bringing the suit would lose. There is no clear cut answer. Bill Stern
