what can I sue for

I live in Houston, Tx & I want to know how I can sue someone in Grand Rapids, MI. I gave a payment for products I didn't receive & it was stated to me I would get a refund & have yet to receive my refund.I was told to get a lawyer in Michigan. Can you refer me to anyone in or around Grand Rapids, MI? Also, if I need to hire an attorney can I sue the other person for my expenses for hiring one & what exactly can I sue him for?

There are a number of good Law Lists that list attorneys that handle collections similar to yours. WWW.ALQLIST.COM, WWW.GENERALBAR.COM, and WWW.COLUMBIALIST.COM are three well-known lists. Or you can check WWW.MARTINDALE.COM that lists almost all the attorneys in the U.S. and search by geographic area and area of practice.

Most will handle a collection matter on a contingent fee basis.

One reply is that you can sue in Federal Court in Texas. That is true if the amount in controversy, exclusive of interest and costs, is $75,000.00 (called diversity jurisdiction).

In any event the out-of-state company in knowingly entering to a contract with a Texan (i.e. selling you the merchandise) likely has subjected itself to the jurisdiction of Texas Courts. If the amount is involved is significant, get an attorney because jurisdiction will be contested. Also, you can recover attorneys fees.

If the purchase was rather recent, most major credit card companies will honor your request to charge back to the seller the price of the undelivered merchandise. I have seen this done successfully as recent as last month.
