Legal Question in Immigration Law in Michigan
Hi, my fiance and I are trying to plan when to get married. He is from Jordan and is in the US on a student visa. I am curious about what legal issues we will face when we get married. I know his student visa will no longer be valid after we get married, so we will have to apply for a green card. What are all of the things we need to do in order to get his green card. I have heard getting a green card can be problematic. He and I havent been together that long (a few months). Would we benefit from a longer engagement (his culture suggests we should get married within a month) when it comes to getting his green card with out problems?

If you are a non-muslim USA citizen and your fiance is a muslim student from Jordan, therefore, there are clear cultural and religious differences, then yes, it's possible that this marriage will be subject to a higher scrutiny by the Department of Homeland Security.

After marriage to you, a US citizen, he will have an option to apply for a green card through a process known as 'adjustment of status'. If and when approved, he will become a lawful permanent resident of the USA, which means he can live and go to school and work in USA.

The marriage as a practical matter may be subject to higher scrutiny, but as long as it is a bonafide marriage it should be OK. All sponsorship paperwork such as petition for alien relative, adjustment of status application, employment authorization and advance parole document applications, etc. can be filed concurrently, and your husband (when you are married) will be able to adjust status in the U.S. without having to depart the U.S.
