Legal Question in Immigration Law in Michigan

my husband is deported from united state after 2 months of jail. he didn't have any other criminal history other than the deportation order. we got married 4 years ago and have 2 children together. i am an us citizen and my kids too. is it possible to bring him back to USA by applying i 130? if it is how long it might take for the entire processing? and what percent chance is positive? please give me any other advice that will be helpful.

The I-130 is a first step only. If approved, he will need a waiver and a permission to reapply for admission after deportation (provided that there is no permanent bar). If a waiver is approved and permission is granted, a visa can be issued. Otherwise, there are bans on reentry based on deportation and possibly some other inadmissibility grounds.

I suggest, you consult a good immigration lawyer because this question's difficulty is beying what can be suggested on a forum.

Hi, the I-130 is to validate the bona fides of the marriage but based on your question, it sounds like your husband must also need two waviers. Whether he qualifes for waiver and the chances of those waivers being granted requires that you provide us with more information. Please contact us at (248) 619-0065 for a free consultation and we would be able to give you a better idea of your options.
