Legal Question in Immigration Law in Michigan

I am currently in USA on a three month visitors visa from Ireland. I am visiting my fiancee. We would like to get married as soon as possible as his mother has terminal cancer and we want her to attend the ceremony. I am unsure which visa I need to apply for, or how long it will take. My visa expires on March 26th and I would like to get married before that date. It is very important for both of us to have his mother present. I would be very grateful for any advice you can offer.

Do you mean that you are currently visiting in USA on a 3-months Visa Waiver (which is not a visa) from Ireland? If so, there is no additional visa to apply for if you are already in USA. As a visa waier visitor you are not eligible to apply for a change or extention of status. Your I-94 card expires in March 2010. If you marry a US citien, you might be still able to apply for adjustment of status (green card) after the marriage if you decide to remain her permanently with your US citizen spouse.

If you marry a U.S. citizen on your current stay, since you were lawfully admitted you may seek the Green Card without having to depart the U.S. right now. Did you in fact have a visa in your passport when you last entered, or did you just show your passport? If you're ready to start the immigration process, you will only apply for the Green Card after you marry -- so there's no other visa you are required to have in order to marry your U.S. Citizen husband.
