my husband has been out of the house since February, can I get his name off the lease legally ?we are seperated

Not unless your landlord permits it and I doubt that he/she will.

If you discuss with your landlord that your husband and you are separated and you would like to resign a lease in your name only, you may be able to work something out. Alternatively you could approach your husband with an agreement providing that although he is on the lease, he is giving up the rights which he had pursuant to the lease because he has moved out. Furthermore, while you could move out and move back in to another apartment in your name only, you will abstain from doing that if he will sign off on his rights under the present lease. This is important to him because if you moved out an into another apartment, he could have some exposure to liability from due to his early termination.
