Legal Question in Landlord & Tenant Law in Michigan
Will an eviction from 6 years ago hurt me now?
I lived at an apartment community that was privately owned for 3 years until I was evicted, due to non-payment. I was young and foolish and couldn't pay my bills. I've since been living with family and have filed bankruptcy. The collection from the apartment is on my credit report, but I've since filed bankruptcy and that debt was included, so it shows as a $0 balance.
If I attempt to rent again, will that old eviction hurt me? And does the fact that it was discharged through bankruptcy make it better, or worse?

If your potential landlord checks your credit and receives a credit report with such negative information on it, then the negative information could hurt you.
The negative information on your credit report can remain there for as long as seven years. However, at any time, you can request of any creditor to take the information off the report. The first step is to dispute the information and the credit reporting agency will then investigate the dispute. If this step does not result in the removal of the negative information, then it is appropriate to contact the creditor to ask that the information be removed. If the creditor will not have the information removed, you still have the option of explaining the negative information with a statement that can be included in your report.
You can also be upfront with the potential landlord explaining to them that a credit check will not be representative because you are now more mature and responsible. Your good faith can be shown with a larger security deposit as well.
