Legal Question in Medical Malpractice in Michigan

death of mother

7/30/02 my mother went to er for chronic headache and was very disoriented. she was diagnosed w/sinusitis. 1 wk later still w/headache went to er, she was admitted. still diagnosed w/chronic sinusitis. told to f/u with pcp. went to pcp still diag w/sinusitis. approx 4 days later went back to er for same. became unconsious and i was told her brain was bleeding possibly due to blood pressure. she expired on 8/18/02. i had a autopsy done on her and till this day they have not determined her cause of death. do i have a case? thank you

When this problem arises, many times we will have an autopsy performed by a pathologist of our choice. Without a cause of death, you will be unable to win the case. Bill Stern

We are sorry to hear about your loss. You may have a case but we need much more information to give you a more definitive answer. How old was your mother? What was her health history? What medications was she taking at time of death? What ER did she go to? These are just some of the preliminary questions we would need answered.

After we get more information, we can have the medical file reviewed by a medical expert. If the expert believes the death was the result of malpractice, then the case can move forward.
