Legal Question in Medical Malpractice in Michigan
loss of a child
Iwas 32weeks pregnant withtwins.I was sent to different facility.I saw a number of specialists that day including an OB/GYN.The OB stated that she would set up appointment for a stress test to be done at my regular OB's office following my visit with her.She thought the twins might need to be monitored more often than every 2weeks.I had been assured that all documents from my visit would be forwarded to my regular OB.I waited a week and did not hear from my OB's office and soI called them regarding my records. They had not received anything from the other facility.I spoke with the nurse coordinator. She stated that all records are supposed to be sent automatically. She noticed mine had not been sent and so she faxed them to myOB'soffice.By the time the records reached the office I was to have my normal 2 week check up as I was 34 weeks along. When I went in for the check up I was informed that one of my twins had passed in utero and that I would need to deliver as soon as possible. My question is: Is there any legal grounds to sue for the loss of my child?Had the records reached my OB's office sooner I would have had an appointment before the death of my child and it may have been detected that I needed to deliver sooner.
