Legal Question in Medical Malpractice in Michigan

Newborn had broken ribs but doctor said it was a air pocket under the skin.

My son was born on Mar.1,2001 He had to stay an extra 5 days in the hospital. The doctor in the hosp said he had a air pocket in the back by his ribs. Six weeks later my son had to have a upper GI done at a differnt hosp they found recovering broken ribs. Doctor immediatly got on the phone with my husband and I asking questions to see if someone had tramatized our son we were so scared that we were going to get into trouble and we did not even know he had broken ribs. So the confussion is why didn't the hosp where we had our son at see that he had broken ribs because he had several x-rays. My pediatrition received the origianl x-rays from when he was born and had a expert radiologist look at them and he said he had broken ribs from the start. Thank You so much!

This may be a case of malpractice or it could also be from the way the baby was turned in the woumb. There is very little space and if the baby is turned a strange way, the ribs could be constrained resulting in a break or lack of development.

Another possibility is the ribs were broken going through the birth canal (assuming there was no C section).
