Legal Question in Medical Malpractice in Michigan
Type your question here...is it right for a er doctor to not look in to the reason why your there and to assume abuse and send you away with no attempt to diagnose a 6 week old baby. I went to the er because my daughter's left arm was swollen the veins were raised and looked discolored i am a new mom and was scared that it was cancer (soft tissue sarcoma) because she was not in a lot of pain and she was moving it normally assuming this is abuse he took an x-ray only looking for a broken arm he did not say more than ten words to me at this time he did not say he saw a fracture. and sent in discharge papers i had no answers so i told them i am going to a different hospital. he called the other hospital and gave then the info so when i went there they admitted and the paper said humerus fracture result of abuse
he also called child protective services and they came and saw me at the hospital and she was being very mean and said " lets hope this is a medical issue or were are taking your child at that point a doctor form that hospital had already came to my room and told me he looked at the x-ray and saw no fracture so i asked her if she spoke to the doctor before coming in my room and she said no. this hospital did the same as the other and only looked for a sign of abuse this may be because i look like i am 16 i don't no they ordered a MRI so i assumed they were going to look in to the swelling and i would finally have a answer after the MRI was done i was given a report of the MRI that said "no definite fracture line " and then discharged from the hospital i spent 4 days in a hospital so they can tell me what i already no that there was no fracture my daughter was later diagnosed at a third hospital with a vascular disorder called Klippel-Trenaunay Syndrome (KTS) witch is incurable and painful .i went through hell and back with CPS trying to clear this it took about 2 months the two previous hospitals still have in there records that this was a result of injury and just recently i receive a letter saying that i have to explain what happened to cause this or the Michigan department of health would stop my daughters medicaid. what can i do about this it really made me have an anxiety attack for the first time in my life
