Fatal Pedestrian accident
Back in December of 2005 My uncle was a pedestrian crossing 8 mile and a Pontiac Aztek with three teenagers in it hit him and killed him instantly. the kids were questioned and released five minutes after the accident the only testing they did was a breathalizer it came back 0, the kids were released and no charges were brought against them, they didnt even get a ticket, they made it out as if it was all my uncles fault because he was walking in the street and he was intoxicated and not in a crosswalk, but he was also an alcoholic, and he could tolerate a lot of alcohol, the case was closed that night saying it was all my uncles fault, and that the kids didnt see him, and the kids said they were going 37-38, my question is the autospy report said he was killed upon impact would a vehicle traveling 37-38 mph. sever his brain stem and crush his whole body? another thing we found out a month later that the person who was driving has a website that supports a band called pedestrian takedown, when you log onto the site of the band it has a picture of a no crossing pedestrain sign with blood splattered all over it.
i was wondering if you think their is a case please let me know.
