how does mini tort pay out if the motorist at fault does not have mini tort with his or her insurance company?

Assuming they are not uninsured, their company owes them the payment of mini tort. If for some reason they are insured by an out if state insurer, they would be personally liable for the $500. Tim Klisz. Kliszlaw.com
