Legal Question in Personal Injury in Michigan

Protecting Patrons

This past weekend, 2 members of my family along with a friend, where all jumped by a group of young men, while attending a movie. The incident did not take place in the parking lot but rather in a hallway/lobby of the theatre. All three where injured, one being knocked out. The associates working for the theatre claim the police would not have done anything and that is why they where not called. The victims did file a police report the next day, in order to have it on record. Could the theatre be held responsible for not providing the proper security, for a location that is known to have problems on Friday and Saturday nights?

Most likely the theater gets off the hook due to the pro-insurance decisions of the Michigan Supreme Court. The Supreme Court has held that the business is generally not responsible for the criminal acts of patrons unless they do something to make the situation worse. If the theater had called the police you might have been able to get the identities of the assailants for purposes of a civil suit.

Furthermore, if they had knowledge of the danger and did not take steps to prevent that danger, then your argument would be that their negligence placed your family members in a position of peril and therefore, they were under a duty to use reasonable care to aid or assist you, to wit, to call the police and/or paramedics.
