single vehicle- rollover -ejected
My husband was in a single vehicle rollover ejected accident 500 ft. from our home, he was ticketed for no seat belt and careless driving (going 35 w seatbelts). multiple cervical fractures and ruptures,broken collar bones, ruptured ear drum, fractured skull and concussion. numb from the ears down still today. he was placed in a halo for 4 months (orginally to be 6 mo.)When the halo was removed in Sept. he started to get a respitory infection which turned into double pnemonia leading to a Thoracotomy.Auto insurance company refuses to pay hospital and medical bills for the thoracotomy stating it isn't auto related. One dr. states it is and another says no.We have stated to them he has never been sick in his life and has only missed 1 day of work in 25 years! He was unable to move about, eat properly, or breathe properly so it would turn into pnemonia
Please Help
Why Do We Have To Pay? Is there anything we can do to Fight this?We also beleive the auto insurance is getting ready to settle we need help with this as well.

It sounds like you'd have a strong case to get them to pay. A lot of it boils down to whether the doctor backing you up has as strong credentials in the area as the doctor not supporting you. See a lawyer who does this kind of work, start suit and if everything goes as planned, they not only will have to pay for the surgery but attorney's fees as well. Before you settle, you should discuss it with a lawyer. The lawyer will most likely not charge you for reviewing the proposed resolution. The insurance company isn't paying because many times they can get away with not paying. They bully people like you that don't know any better! From the facts you present, you have a good case to make the insurance company pay the medical bills, lost wages (up to three years), and other costs you have incurred - not to mention your attorney fees. Its likely the insurance company is simply seeing if they can get away with not paying. Don't take less than full payment without consulting with a lawyer.
