Legal Question in Real Estate Law in Michigan
How do you evict 40 year old son?
I need help for my friend. Your input will be greatly appreciated.
My friend is in her 60's and has a 40 year old son living at home. He has been in trouble with the law several times, and just got out of rehab for substance abuse (court forced treatment). My question is this: ****What procedure must she follow to successfully evict her son from her house?**** He has lived there for years (Cass County MI). He has a patern of alcohol abuse and is drinking again, fresh out of rehab (I think the court would have something to say about that.) He barely has a job (usually around two days a week), pays extremely minimal rent to his mother. She keeps letting things slide with his irresponsible/destructive life, and won't take action. I think she's basically numb to it now. Please give me some information that I can pass along to my good friend. She deserves a life of her own, but that's nearly impossible with him around. Thank you for your help.

To Whom It May Concern:
This is in response to your email of September 16, 2001, which this office received on October 26, 2001.
If the son is not on the deed to the home, your friend may want to obtain a Personal Protection Order against the son if he will not voluntarily leave the home. This could be faster than a formal eviction. If your friend wants to evict her son, she can get the necessary forms from the local district court and file the forms there. The court will then set a hearing date.
