Legal Question in Real Estate Law in Michigan
Rental Deposit
We provided our information (credit) to help a family member rent an apartment. The apartments only charges $100 security deposit and now are claiming that the carpet has to be cleaned and the apartment painted. Obviously, if needed I will be charging our family for this and it is alot more than $100. My question to you is, if they only charge $100 for security deposit, is the tenant still reponsible for any damages over that amout?

Re: Rental Deposit
Yes, the tenant is responsible for damages not attributable to normal wear and tear. Furthermore, the landlord is required to use the inventory checklist in order to assess and evaluate damages.
Typically, scuff marks on the wall are normal wear and tear. For a more thorough discussion of this topic, please visit my website at www.lawrefs.com under the heading landlord tenant.
