Legal Question in Real Estate Law in Michigan

Roomate

I rented a house with my boyfriend and had problems. He moved out and he is on the lease but did not sign it we both agreed to pay half the rent and bills. Can I take him to small claims couts for his part of the rent for the remainder of the lease. We had just moved in this house and lived together for 3 years prior. I am not out for revenge I just can not afford the house on my own I have 2 children to support and the house is not big enough to have a roomate.

If he is on the lease you can sue him. You both would be responsible for the lease jointly and severally.

To Whom It May Concern:

This is in response to your email of September 18, 2001, which this office received on November 5, 2001.

If you continue remain in the rented house and signed a lease, either yourself, your boyfriend or the both of you are liable on the lease. If your claim meets the statutory requirement for Small Claims Court or even District Court, you can proceed on this matter.

Our rates are $175.00 per hour and prior to beginning work, a retainer of $3,000.00 would be required.
