Original Charge of Leaving the Scene of an Accident
My 17 year old daughter lost control of her car on a snowy/icy back road and hit a tree. She was approx. 200 yards from her boyfriends house and went there for help. She came back to the car with him to look at the damage. She then went back to his house to call for help and the police. In the meantime, a State Policeman came upon the scene. They called us (parents) to find out who the driver was. In the meantime, she went back to her car again and was issued a ticket for leaving the scene of the accident. We have already seen the asst. DA and they said we could plead down to Failure to Report an Accident (mis) or driving too fast for conditions (2 points). Do we hire an attorney and fight this or agree to one of the offers that was made. She already has an accident and 2 points on her license.

There are two different Fail to Report an Accident charges that "may" apply. 257.622 is zero points on her license and doesn't get sent to the Secretary of State. The other, 257.618 is a whopping 6points on her license! Both are misdemeanors.
Considering the impact that any additional points on your daughters license could have on your insurance rates, I would at least consult with an attorney.
