Legal Question in Wills and Trusts in Michigan

My Dad passed away. He was remarried less than six months. I'm the 401k beneficiary. His wife isn't listed as a beneficiary does she still have rights to it?

Probably not. You make the claim to it and they pay you by contract. She gets a portion of his estate by law, but beneficiaries follow the contract, not probate law. This is overly simplistic, of course, and you should follow up for true legal advice. www.kliszlaw.com Tim Klisz
