The will needs to be clear and obvious that he is cutting one out in favor or the other. I would be happy to write him a proper will. Tim Klisz kliszlaw.com
It is very important that your father in law see a lawyer to ensure his wishes are upheld. He may leave everything to one child by simply stating his wishes, however, the other child may contest same if he tries to do the will himself under duress, undue influence, incompetence and/or mistake. Using a lawyer will cover all the necessary questions he will have to answer so the lawyer, who is a more nuetral person than family, would be able to testify that your father in law knew what he was doing and was competent at the time. I have helped many people with similar plans, please contact me at 888-988-LAWS (5297) or [email protected] to discuss in more detail.
