Legal Question in Wills and Trusts in Michigan

My husband was named executor of his friend's will. We go to probate on 12/16/2011. The lwayer that drew up the will wants us to go out to my husband's friend's house on 12/17/2011 to get everythong ready for auction. Shouldn't we find out what bills he has before we auction everything off? Isn't it true for unsecured debt you just have to send the creditor a death certificate to clear out that debt?

That is not correct. The unsecured debt can collect from the probate estate when there is one (obviously yes because you are going to Court) If there is no probate assets, then cancelling the debt is common. Tim Klisz kliszlaw.com
