New will after mother's stroke
My father died and my mother had a stroke and nearly died from a brain tumor soon after. My aunt and sister got my mother to sign a new will in the nursing home, even though she had ''cognitive problems'' and problems identifying the use of ordinary items according to her physicians. My mother has since died. The new will gives me only about 20% of the estate compared to 50% in the trust that was signed 13 years before. What chance do I have to win in court? The lawyer for my aunt said my mother understood him, even though there was no way she could have dictated or discussed a will with him along with the complex details it included. My aunt helped her sign the papers.
