Legal Question in Wills and Trusts in Michigan

No will, a pile of debt, a child's nightmare

Both of my parents passed way

recently without a will, but with a

house with a mortgage, a pile of bills

in collections, and with a small

amount of life insurance. With the

condition of their house and the

current market, the house is not

selling. I am wondering if I cannot

liquidate their only asset (the house)

how am I expected to pay off this

mountain of debt? Currently I am

paying her mortgage, but I am at

the point where I just dont see the

point.

I guess what I am asking is: as her

personal representative, what steps

should I be taking.

Should I be paying he mortgage,

power bill (to keep the pipes from

freezing) etc?

How long do I have to pay these

bills?

What happens if I cant sell the

house before that time period ends?

I have filed the information with the

court, I have been appointed as her

personal representative, I have

posted a notice to her creditors, I

have given them all the new address

to mail information, what steps do I

take?

Make no further payments until you immediately speak with an estate attorney. We offer free initial consultations. Call 480.835.1500. Sounds like the estate is insolvent. We can help, but it would require too much space here to list all the things you should do, and more exact facts need to be known. You are not liable for the estate debts if you handle this properly.
