Legal Question in Wills and Trusts in Michigan

Witness during Probate Trial

I am in the middle of a Probate trial without an attorney (he left) and I have in evidence a report (A) from a doctor. I do not have this doctor on my witness list. I have a report (B) from another doctor which was done before report A. That doctor is not on the witness list either. I have on the witness list - any and all witness that may be used as rebutal witness and also any and all witnesses that may be identified during the discovery process. Can I bring in the docotor who did report A and have them give an opinon on the other doctors report B. Can you explain what the two general witness statemens (rebutal & during discovery) on my witness list mean. If I can not use one of these then how do I bring the doctor in? This case involves a person with dementia and needing 24 hr. a day care. Both reports state this but report b is not in evidence and the dr. will not testify. I can not afford to subeona him or do a deposition.

Re: Witness during Probate Trial

If you insist on practicing law. . . wait . . . is the court allowing you to represent someone without a license to practice law? You may have a problem more basic than your questions about how to admit evidence. In the event you are for some reason allowed to advocate at trial, you will need to study and become familiar with the court rules and rules of evidence.

Good luck.
