repayment of medical insurance claims
I injured myself 20 minutes before my shift started while walking into work. I turned my ankle on bad concrete, breaking my foot and injury my knee and back. This was 2 years ago. I was off work for 2 months. My doctor wanted to keep me off but an IME insisted I go back and to avoid risking my job I returned as an injured employee. I have been off repeatedly since when I could no longer stand the pain, during which time the company would not pay my claim. I've used my medical insurance to cover costs for treatment. Now my attorney is close to getting the company to agree to pay my mileage, out of pocket medical, lost wages and to reimburse the insurance company. My first question is do I have to pay a fee to the attorney based on everything he recovers, including the insurance reimbursement? Shouldn't the insurance company use their own attorney and pay for that themselves?

He may be able to get the employer to pay his fee on the medical. That will probably take a trial, however. You will definitely be responsible for his fee on wage loss. William S. Stern
