Mileage reimbursement

I am employed by a company that provides drug screening, and am required to use my own vehicle. The protocol for one of their customers says they reimburse .44 a mile. The company gives me .32 a mile. They don't do any of the driving. Is this legal?

Your question indicates that your mileage reimbursement is part of your contractual relationship with your employer. While you are working for your employer, you are entitled to the reimbursement under the terms of your employment agreement with your employer. Although a customer may reimburse at a higher rate, you are not their employee, and your employer can legally pay you the amount provided in your employment agreement.

Notwithstanding the above, you may wish to consult with your employer and advise them of the different reimbursement rate offered by one of your customers. Perhaps you can receive that rate when doing work for that particular customer.
