Legal Question in Business Law in Minnesota

Non-solicitation agreement

My company is asking me to sign a non-solicitation agreement. I am an account executive, with an anticipated income of $120,000 per year, commission only. The term of the agreement is two years, and the non-solicitation term is two years after cessation of employment. The company is offering me $1,000 to sign the agreement. Is this a fair value for signing, and if not, what would be?

Unfortunately, the information you seek is specific legal advice. I cannot give you advice on the offer amount or the terms of the agreement without being retained as your counsel and performing a conflicts check to ensure that the company is not represented by my firm. Please contact me directly if you would like to retain me as counsel.

Re: Non-solicitation agreement

GIven your facts, the amount offered would be questionably sufficient. I have litigated a number of non-compete battles and if you are not being PAID not to compete (during the term following termination) the amount offered to sign it (assuming a mid-stream agreement) is nominal, and subject to challenge.

Call or email to discuss further.
