Legal Question in Civil Rights Law in Minnesota
John works for a magazine publisher. He works out of his home and furnishes his own supplies. He pays his own taxes and uses his own car for his work. The magazine publisher reimburses John for gas mileage. While driving in his car on a work-related matter, John is involved in an automobile collision with another automobile. What would it take to hold the corporation liable?

It would appear that John is an independent contractor and, as a result, the employer would have no obligation. The only way to qualify for workers' compensation is to be considered an employee.
