Legal Question in Consumer Law in Minnesota
ripped off
I recently hired someone to re-do my basement. He gave an estimate of $8,000.00 to complete the job stating that he would sheetrock, mud, tape and primer, install trim and flooring throughout. He also stated he would show me receipts throughout the whole process so I can see where my money was being spent. He estimated materials to cost $3,500. I paid him this amount upfront and then approx. a week later, he asked for an additional $2,500 because his crew wanted to get paid to which I gave him. About a week after that, he asked if I would purchase the paint. I began to question where my money was going and requested to see the receipts. He then called me a tight wad and packed up his tools stating that he never said he would mud, tape or primer and to call him when this was done and he would finish installing the flooring in 3 weeks and by the way he stated I still owe him the remaining $2,000 dollars. It has been over a week and I have attempted twice to call him to discuss the situation but he is not answering my calls. I looked up his record and he has several conciliation's. He has ripped many people off. He also has a serious criminal record. What are my rights? I don't even want him back in my home!

Was there a written contract utilized?
If not, you may need an attorney to assert and collect your claim. There may also be a bond involved, depending on the city/county.
To collect may require going after (garnishing) current customers, unless tangible assets/accounts can be located.
