Legal Question in Credit and Debt Law in Minnesota

We have two credit cards 23,000 and 7,000 both with capital one. They sued us and won a garnighment in the ammount of 30,000(7000 interst over a year and a half) i called to offer 5000 to the collection agency on the second card, collection agency stated they ran out of time to sue us on the second card, and sent it back to credit card company. My question is can they just send this to another collection agency or do i call and negotiate with credit card company or is it too late for them to sue us on the second card? The garnishment will take us roughly 2 years to pay off on the 30,000 ammount.

A) You should consider bankruptcy, either ch. 13 or ch. 7. You should contact a bankruptcy attorney near you.

B) You should consult a legitimate debt management company, such as Lutheran Social Serivces or Family Means or the Village. If it is already at judgmetn stage it is likely too late, but they might be able to help and certainly won't hurt.

C) Go to www.mncourts.gov and look yourself up to see what law firm obtained the judgment and negotiate with that law firm, not some random collection agency.

Good luck.
