Legal Question in Credit and Debt Law in Minnesota

My mother passed away on 7/1/09 with credit card debt. The credit card company is stating they will attach a claim on her estate. The only thing she has is a house, and that is joint with my brother. He has since her death, removed her name from the mortgage so he is the only one on the deed, etc. Can the credit companies still attach a lien? If the house is sold and proceeds are divided amoung the 3 living children, does the credit company get a portion of those proceeds?

They would need to make claim vs. estate and/or obtain a judgment. Was there a will?
