Legal Question in Credit and Debt Law in Minnesota

My wife and I moved to Minnesota a little over a year ago. My employment had ended in Wisconsin and we were having a really difficult time finding work. I found a job here in Minnesota but at substantially less then what I had been making. An Attorney sent us a summons on the ninth of December so my wife called the collection agency that the attorney told here to call and made payment arrangements. We thought it was all taken care of since we were making payments but then today we got another summons as if we hadn�t made payments at all. Can they really freeze my bank account or garnish my wages even if we are making payments?

I should review the documents your received to determine if they have proceeded to obtain court relief on the debt. Unless there is an enforceable agreement to forebear from litigation, they may proceed to obtain judgment and garnish, execute etc. even if payments are being made.

Most of the time litigation can be avoided via a payment plan, but the agreement must clearly define amounts and the creditors limitations.
