felony theft
i moved to mn in 2005 i got a job at an healthcare an didnt report my income to welfare and i wked for 5 months now im being charged with a felony theft what is the jail time i may receive

Thank you for your question. I take it from the reference to an "omnibus" hearing that you have been charged. The answer is that, yes, you can be sentenced to jail for welfare fraud. Whether you would actually serve time depends on a number of things: the amount at issue, how long you received benefits when not entitled to them, how much you were earning, whether you have any prior violations, etc. In addition, it would also make a difference which county you are in, the judge, and whether you are represented.
My guess is that, if you were working, or are currently employed, you may not qualifiy for a PD. If you do qualify, you should address this question to your lawyer. If you do not qualify for PD, you should have representation.
