Legal Question in Criminal Law in Minnesota
iv been dating this girl for 2 months and we hit it off. but recently after a date we got pulled over and the officer carded us both and i found out she is 16 and i was 21 at the time. the officer said if i was 2 months older i would have gone to jail but that i was within the 48 month line. but i dont think i am. i was wondering if there is any thing i can do to protect myself from going to jail if we continue dating. her parents permission to date for example. i would also like to know if we actually are legally able to have a relation ship and if im within the 48 month limit.

In Minnesota, the age of consent is 16. Most times, this means that as long as both partners are at least 16, any age difference between them does not matter. Perhaps the more important question is what a 21 year old wants with a 16 year old, legal or not.
You stating there may be a '48 month limit' issue does not make sense for the facts as stated. "Dating" is never illegal. However, sexual contact may be depending on the circumstances. Generally, the age of 16 is the age of consent unless the older party is in a position of authority such as a coach, teacher etc...
