Legal Question in DUI Law in Minnesota

Around May 25th, I was pulled over for a DWI, I signed a letter of revocation stating my license would be revoked for 90 days. In the mean time I went to court the very following week and my case was dismissed because the cop did not complete the paperwork. My license was still revoked for 90 days and I am eligible to get it back on the 30th of this month. I also got paperwork in the mail stating I have to go back into court for my DWI, Is this correct? I am confused, it was first dismissed but I still lost my license and now I have to go back to court again after dismissal? Can you help and tell me if this is the law?

It sounds as if the charges were dismissed and then reinstated. This does not happen often, but it does happen.

For example, I had a client who was given a blood test and charged with DWI. When we got to court the blood test results were not yet in, so the city attorney dismissed the charges. After the city attorney saw the blood test results, he charged my client again based on the blood test results. It sounds as if something like that happened in your case.

If you don't know why this is happening to you, it would be a really good idea to get a lawyer involved. In fact, even in a case with nothing at all unusual, it's a good idea to get a lawyer. If the charges were dismissed "with prejudice," then they are not supposed to be reinstated. Ordinarily, however, the dismissal would be "without prejudice."

Trying to handle this on your own is like doing brain surgery on yourself. If you don't understand what's happening now, just wait. That will get way worse.
