Legal Question in DUI Law in Minnesota

Underage DWI

I'm 19 and was pulled over for swerving. I passed the first two field sobriety tests but failed the last one. I then blew a .23. I was then put in the back of the cop car. They proceeded to search my car finding a few things. The cops had me call my parents and went home with them. I'm being charged with DUI, possession of drug paraphenlia, and underage poss. of alcohol. What am I looking at for penalties?

Re: Underage DWI

That's about three times the legal limit, a bad start for someone as young as yourself. You will be charged with at least one gross misdemeanor and probably a string of misdemeanors. A gross misdemeanor carries a max penalty of a year and $3,000 fine or both. Misdemeanors are maxed at $1,000 or 90 days or both. This is serious. You need a lot more than a question at this forum.

The court is going to be trying to figure out how you developed a tolerance so early in life. Most people would pass out before they got to .23. So how could you be operating awake AND driving with that kind of reading? The judge will send you to probation; and the probation folks will probably want you to go to treatment.

Expect several days in jail. Expect at least six months without a license to drive. For more info, go to mn-dwi.com.
