child support and custody

My fiance has 2 children from a previous marriage, ages 11 and 7, who spend 4-6 days a week with us. His ex-wife has custody and receives child support from my fiance but she barely ever has them. Now we have a newborn baby to provide for as well. His child support had just been calculated 2-3 years ago but alot has changed since then. What can he do to get his child support stipulations changed?

You would file a Motion to modify. However, given the complexity of the new child support laws in Minnesota, you would be wise to consult with counsel.

He would have to make a motion to amend and prove that a substantial change of circumstances occurred. That is usually based on changes in income but can include changes in expenses. Also there is a new child support statute that applies. The only way to know whether it makes sense is to call an attorney. Dennis
