Generally, the Court will not allow a termination or parental rights unless

it is determined to be in the best interests of the children.

In most cases, the court will not find it to be in the children's best

interests unless there is another person willing to step into the shoes of

the non-custodial parent by adopting., The reason for this is rather

mercenary. The state does not want to have to support a child in the event

something happens where the non-custodial parent cannot work. As a result,

they will not terminate parental rights so long as there may be an

obligation of financial support.

Response: Sounds as if you are talking about a proceeding to terminate the guy's parental rights. Under most circumstances this just can't be done. The one exception might be if you were to remarry and your new husband was to do a step parent adoption with your x-husband's consent.
