Military law - custody

A couple with children is divorced.

Parents share legal custody. Mom

has full physical custody with father

granted ''reasonable visitation.''

Father is deployed to Iraq and gives

stepmom power of attorney over

children. Does stepmom get

'reasonable visitation' or can mother

deny stepmom visitation until father

returns from military duty? Thank

you

The court order for parenting time only applies to the parent. It cannot be assigned to a step mother by Power of Attorney. To exercise time with the child, the matter should be returned to court on a Motion so that the issue can be addressed by the court.
